Federation of Parents and Citizens Associations of NSW Online Community Terms & Conditions

Thank you for being part of Federation of Parents and Citizens Associations of NSW Online Community (“community”). The community is developed and operated by the Federation of Parents and Citizens Associations of NSW (“P&C Federation”, “our”, “we” or “us”). To ensure the best possible experience for users of the community (“users”), the following terms and conditions apply to the use of the community (“T&Cs”).

Acceptance and Variation of T&Cs By joining and using the community, you agree that you have read, understood, and will follow these T&Cs in full. If you disagree with any provision of these T&Cs, you must not register an account with the community, post any material on the community, or use the community in any way.

These T&Cs take effect when you click the “I agree” button or check box presented with these T&Cs when you register or, if earlier, when you post any material or send any message to us or other users on the community.

We may update these T&Cs at any time by posting an updated version on the community. By continuing to use the community, you agree to be bound by the latest T&Cs. It is your responsibility to check regularly for any changes to these T&Cs. If you do not agree to the latest T&Cs, you should cancel your account registration and must cease posting any material on the community, or use the community in any way.

Acceptable Use

The community is developed and operated by P&C Federation NSW to facilitate the performance of its functions and objectives, including:

· To promote public education and facilitate community involvement in public education;

· To support and promote the interests of students, and parents of students, enrolled at government schools;

· To co-operate with the Department of Education, regulatory bodies and community organisations having an interest in public education, in relation to matters involving public education and the role of parents in public education; and

· To assist Parents and Citizens Associations in carrying out their functions or activities.

You must not use the community in any manner that conflicts with the P&C Federation’s functions and objectives.

You must not:

1. Use the community to publish, send, or use any material that is sensitive, confidential, defamatory, abusive, profane, threatening, offensive, illegal, unlawful, infringing a person’s rights;

2. Do or try to do anything that will subject the P&C Federation and/or P&C Associations to any legal action or any criminal, regulatory or other investigation in any jurisdiction and under any applicable law;

3. Publish, send, or use any material protected by copyright, trade mark, or other proprietary rights without the express permission of the owner of such material;

4. Do or try to do anything that threatens the security or integrity of the community, and/or inhibits or impairs the performance, availability, or accessibility of the community;

5. Publish, send, or use any material that encourages or facilitates an agreement about the following subjects: prices, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers;

6. Register with the community if you are under 18 years of age;

7. Use any other user’s identity or a false identity to log into the community or misrepresent your identity of affiliation with any person in any way; or

8. Conduct any systematic or automated data collection activities on or in relation to the community without P&C Federation’s express written consent.

If you breach any provision of these T&Cs and/or do not follow the House Rules available on the community FAQs page, or if we reasonably suspect that you have breached these T&Cs, we may remove any or all of your posts, immediately, temporarily or permanently suspend or terminate your account, report you to the relevant law enforcement authorities, and/or take legal action against you.

Intellectual Property

We own and control all the intellectual property rights in all the materials posted by or on behalf of us on the community.

You grant us a non-exclusive, sublicensable, revocable, worldwide, royalty-free licence to use the intellectual property rights in all the materials you post on the community in connection with P&C Federation’s functions and objectives.

Role of Moderators

The community may be moderated by P&C Federation to support users in using the community. Moderators of the community may review your posts (including comments to a post) after they go live.

Moderators may remove, edit or ask you to amend your posts or messages if they do not follow these T&Cs. If you disagree with the moderator's decision, please contact our user services department via the Contact Us link on this site.

Despite the use of moderation in some circumstances, you are solely responsible for complying with these T&Cs when using the community.

Privacy

The protection of your personal information is very important to us, and we believe that you should know how the information is utilised. Our commitment to ensuring the privacy and security of your information is set out below.

You may be required to provide personal information to register an account to gain access to the community.

Except for registration to gain access to the community, you will not be required to disclose any personal information of yourself or any other individuals while using the community. As we are not in a position to review all posts or messages and determine whether they include personal information, we will not be responsible for the privacy and security of any such personal information included in the posts or messages.

Who Do We Share Your Information With?

The P&C Federation only collects personal information in connection with carrying out its authorised and permitted activities. We will only use your personal information for the purpose(s) you have provided the personal information, or for a purpose to which you have consented.Information shared with us for your account with the online community will only be used

  • to enable you to access and use our community;
  • to provide you with services, or information regarding the online community
  • for analytics, market research and development including to operate and improve our website;
  • to communicate and administer our relationship and dealings with you efficiently.

If you would prefer not to receive promotional or other material from us, please let us know by sending an email to mail@pandc.org.au and include the word unsubscribe in the subject.  Alternatively, simply select the “unsubscribe” option in any of the emails that you receive from us.

We may disclose your personal information if we are required by law to do so, or if you violate our Terms and Conditions.

How Does P&C Federation Collect & Hold Your Information?

We usually collect your personal information directly from your online community account.

 

P&C Federation uses physical security and other measures to ensure that personal information is protected from misuse, interference and loss; and from unauthorised access, modification and disclosure. We maintain computer and network security by using firewalls, user identifiers and passwords to control access to our computer system. 

Cookies

When you visit our websites we collect information, such as your IP address, device information site visit history via the use of cookies. We also track a visitors behaviour to help provide us with analytical insights and tailored marketing campaigns. You can review our Cookie Policy further below.

Disclaimer

The community is provided as a service for P&C Federation, its members, parents and carersand provided to the users “as is”. P&C Federation and Parents and Citizens Associations of NSW (“P&C Associations”) are not responsible for and do not warrant the legality, non-infringement, accuracy, and accessibility of any materials including opinions, statements, videos, images and links to third parties’ websites posted on the community by users and any third party. This is the case even where a level of moderation is applied by us.

To the extent permitted by applicable law or to the extent any statutory rights apply that cannot be excluded or limited, P&C Federation and P&C Associations (a) do not provide any representations or warranties of any kind regarding the community or any materials posted on the community; (b) disclaim all warranties including implied or express warranties of merchantability, fitness for purpose, non-infringement, and that the community will be uninterrupted, free of harmful components, and that any material will always be accessible, secure, lawful, accurate and up to date; and (c) do not endorse any goods and/or services that are posted on the community. You are responsible for your reliance of any materials posted on the community.

Limitations and exclusions of liability

The community and the materials and services provided in the community are provided free of charge to the users. To the extent permitted by applicable law, P&C Federation and P&C Associations will not be liable for any loss or damage of any nature, including without limitation, any loss of business, profits, data, and use. You will not bring any claim in relation to the community directly against P&C Associations.

Law and jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of New South Wales, Australia.

Any disputes relating to these T&Cs shall be subject to the exclusive jurisdiction of the courts of New South Wales.
